First Year Limited Warranty (Parts and Labor)
For one year from the date of delivery or pickup, when this motorcycle is operated and under proper use, Current Motor Company (“Current Motor”) will pay for factory specified parts, standard shipping and labor for all major components defined herein as including the motor, motor controller, power pack, frame, swing arm, fork, rear shock, brake assemblies, wheels, and electrical sub-assemblies (“Major Components”) to correct defects in materials or workmanship in the Major Components that existed when this motorcycle was delivered.Three Year Limited Warranty for Battery Pack
For one year from the date of delivery or pickup, when this motorcycle is operated and under proper use, Current Motor will pay 100% of the costs factory specified parts, standard shipping and labor to correct defects in materials or workmanship of the battery pack of the motorcycle as identified in the Owner’s Manual (the “Battery Pack”) that existed when this motorcycle was delivered.
During the second year from the date of delivery or pickup, when this motorcycle is operated and under proper use, Current Motor will pay for 66% of the costs of factory specified parts, standard shipping and labor to correct defects in materials or workmanship of the Battery Pack that existed when this motorcycle was delivered. You shall be responsible for all remaining costs.
During the third year from the date of delivery or pickup, when this motorcycle is operated and under proper use, Current Motor will pay for 33% of the costs of factory specified parts, standard shipping and labor to correct defects in materials or workmanship of the Battery Pack that existed when this motorcycle was delivered. You shall be responsible for all remaining costs.
YOUR SOLE AND EXCLUSIVE REMEDY UNDER THIS LIMITED WARRANTY SHALL BE PRODUCT REPAIR AS PROVIDED HEREIN.Eligible Products
This limited warranty applies to all Current Motor motorcycles purchased through the Current Motor website and owned and operated under proper use.Limited Warranty Exclusions This warranty does not cover:
- tire wear
- brake pads or rotors
- fork seals
- the seat
- aftermarket accessories - if you wish to fit aftermarket equipment to your motorcycle then please be aware that you may be voiding certain aspects of your warranty
- Major Components or Battery Pack damaged by use or operation under abnormal circumstances or contrary to the requirements described in the Owner’s Manual, or damaged by improper use (including race competitions) or accidents
- damage caused by improper storage, or alterations of any kind
- damage caused by collision, accident, or tipover or
- damage of Battery Pack or Major Components due to normal wear and tear.
Racing or competitive use voids this warranty. Modifications or alterations to Major Components or Battery Pack or their subcomponents void all warranties. Modifications or alterations to electronic components or such components functionality void all warranties. Current Motor assumes no liability for any misuse or improper operation of Current Motor’s motorcycles.DISCLAIMER OF IMPLIED WARRANTIES
IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED TO ONE YEAR FOR THE MAJOR COMPONENTS AND THREE YEARS FOR THE BATTERY PACK OR THE SHORTEST PERIOD ALLOWED BY LAW. Some states do not allow limitations on the duration of implied warranties of merchantability or fitness, so this limitation may not apply to you. Current Motor makes no representations about the quality, durability, or need for service or repair of the Major Components or Battery Pack other than the representations contained in this limited warranty. If you want a longer or more comprehensive warranty than this limited warranty that comes with the motorcycle, you should contact your Current Motor dealer to inquire into buying an extended warranty.LIMITATION OF REMEDIES; EXCLUSION OF INCIDENTAL AND CONSEQUENTIAL DAMAGES
YOUR SOLE AND EXCLUSIVE REMEDY UNDER THIS LIMITED WARRANTY SHALL BE PRODUCT REPAIR AS PROVIDED HEREIN. CURRENT MOTOR SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, including but not limited to: expense of returning the product to a certified service center, expense of delivering it back to YOU, mechanic’s travel, time, communication charges, rental of a like product during the time the warranty service is being performed, travel, loss or damage to personal property, loss of revenue, loss of use of the product, loss of time, or inconvenience. Some states do not allow the exclusion or limitation of incidental or consequential damages, so these limitations and exclusions may not apply to you. This limited warranty gives you specific legal rights, and you also may have other rights that vary from state to state.
Current Motor reserves the right to change or improve the design of any motorcycle or parts without assuming any obligation to modify any motorcycle or part previously manufactured.Proper Use
For the purposes of these warranties, “proper use” means only the use of a motorcycle in the manner intended as described in the Owner’s Manual on safe surfaces in accordance with local, state and federal laws, rules and regulations.Owner’s Responsibilities
Read and understand the Owner’s Manual and all warnings before operating your motorcycle. Serious injury or death may result from improper operation or failure to observe warnings and safety instructions on any motorized motorcycle or vehicle. Once your motorcycle is shipped, you will be sent a link to an online warranty registration form. Make sure to complete your online warranty registration within the required time period. Perform routine care and maintenance of motorcycle and power pack as detailed in the Owner’s Manual. The rider is responsible for learning and obeying all federal, state and local laws governing the operations of an electric motorcycle. Always wear a helmet, goggles, appropriate boots and all other appropriate safety equipment when operating a motorcycle.Warranty Procedures
If you believe you need warranty service, please check with your Owner’s Manual first. If you are unable to correct the issue after checking your Owner’s Manual, you may obtain warranty services by contacting your local Current Motor dealer; please see the locator on www.currentmotor.com for the nearest location. In the event that a dealer is not located in your state, you can contact Current Motor directly at the address below, 877.222.5115, or via e-mail at email@example.com. In any written or telephonic communication, please state the specific nature of and any circumstances leading to the problem.
Current Motor shall, remedy defects under the terms of this limited warranty provided that you:
- provide satisfactory proof of any defect,
- establish that the motorcycle has not been altered or modified in any manner without our prior written consent,
- provide proof of ownership and original delivery or pickup date; and
- if requested by Current Motor, return the defective motorcycle to us and pay all expenses as set forth herein.
The repaired, replacement or updated motorcycle shall be delivered, free of charge, to you F.O.B. Current Motor’s warehouse or at our option, F.O.B. our authorized dealer. You shall pay all cost applicable to the motorcycle following such delivery, including, without limitation, all handling, transportation, assembly, installation, insurance, testing, and inspection charges

You agree to assume all risks, and release the Released Parties (as defined below) from all liabilities, when allowing others to operate your electric motorcycle. If you are not familiar with the nature of riding an electric motorcycle, you should seek professional training before operating an electric motorcycle.Inherent Risks
WARNING: Riding the Products off road or on road involves risks and dangers of serious bodily injury including, but not limited to, disability, paralysis, dismemberment and death. These inherent risks and dangers may be caused by a rider’s own actions or inactions, the actions or inactions of others, participating or not participating in the activity, the condition in which the activity takes place, or the negligence of others. There may be additional risks, including social and economic loss, either known or unknown to you, not readily foreseeable, and you fully accept and assume responsibility for all such risks, losses, costs, or damages incurred as a result of your participation in riding an electric motorcycle. You agree that CMAA and Manufacturer assume no liability for any of these risks or dangers and that you own and operate the Products at your own risk.Safety Features
You shall operate the Products properly and according to the Owner’s Manual and shall not remove or change a safety device, warning or operating instruction that Manufacturer places on the Products.Order Acceptance Policy
You may place your order on the Website at any time (subject to any planned or unplanned periodic downtime). Your submission of an order shall be an offer to purchase the Products. Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute acceptance of your offer to purchase. CMAA reserves the right at any time after receipt of your order to accept or decline your order for any reason. CMAA reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. We may require additional verifications or information before accepting any order. You are responsible for all fees and taxes, such as sales tax, applicable to the purchase of the Products from CMAA.Options
You may customize the Products as allowed on the Website. However, Manufacturer does not allow customization outside of the options provided on the Website. Upon submitting an order, you may not change any customizations and CMAA takes no responsibility and no liability for any customization choices. ALL OPTIONS AND CUSTOMIZATIONS ARE FINAL UPON SUBMISSION OF AN ORDER AND MAY NOT BE CHANGED.No Refunds or Exchanges
Once the Products have left Manufacture’s warehouse, your order cannot be canceled. Cancellations must be submitted in writing and are only accepted from the date of order and up to one week before the shipment date determined by CMAA. Except as set forth in this Agreement, all sales are final and you will not receive any refunds or exchanges for items purchased through this Website. You may receive a refund or exchange the Products if you notify CMAA within 21 days of the date of delivery if you believe any part of your purchase is missing, wrong or damaged if the Products are returned to CMAA in the same condition as received and with their original packaging.Payments and Disputed Payments
CMAA accepts Paypal, which in turn accepts major credit cards, checks and any other method of payment as posted on the Website. Upon placing an order for the Products, we require an initial deposit of one-half of the purchase price with the final balance due prior to the expected shipment date. Prior to shipment, we will charge the credit card provided by you or will contact you by phone or email to obtain payment information for the balance of the purchase price. You will bear all costs associated with a disputed credit card charge that results in an action from our merchant account provider, otherwise known as “chargebacks”. You will also bear all costs associated with any check returned for nonsufficient funds.
Prices offered on the Website are quoted in U.S. Dollars (unless otherwise indicated for international sales). Such prices do not include shipping and handling, expedited service, or sales taxes, if applicable, which will be added to your total invoice price. You are responsible for any shipping and handling charges and state and local sales or use taxes that may apply to your order. You may pick up the Products from a location designated by CMAA at no additional charge. However, you will be charged a reasonable storage fee for any Products not picked up within 30 days of delivery to the designated location.
If the amount you pay for an item is incorrect, regardless of whether it is an error in a price posted on this Website or otherwise communicated to you, we reserve the right, prior to one week before the expected shipment date and at our sole discretion, to cancel your order and refund to you the amount that you paid. This policy will apply regardless of how the error occurred. Order Status Once you place an order, CMAA will send you confirmation within 10 business days and provide you with an order confirmation number and an expected shipment date form the manufacture’s warehouse. Any shipment date stated by CMAA is an estimation and is not binding on CMAA. When your order is shipped, CMAA will send you a shipment confirmation with the shipping carrier tracking number, if available. By placing an order with CMAA, you consent to receive emails from CMAA regarding your order. Time is not of the essence. Unless otherwise specified herein, CMAA shall deliver the Products F.O.B. carrier at the Manufacturer’s warehouse or F.O.B. designated location. Partial deliveries shall be permitted.Operation, Registration, and License
You are responsible for registering and operating the Products in accordance with local, state, and federal laws, rules and regulations and obtaining proper and sufficient insurance. CMAA makes no representations that the Products are legal for operation in your city and state and shall not be liable for your operation of the Products in violation of city, state, or federal laws rules or regulations.Warranty
CMAA provides no warranties for the Products. However, you shall be entitled to the Manufacturer’s warranties, if any, as set forth in the Manufacturer’s written limited warranty provided with the Product and as set forth on the Website and any other third party warranties covering specific parts. THERE ARE NO OTHER WARRANTIES WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE WHICH EXTEND BEYOND THE ABOVE DESCRIPTION HEREOF, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SOME STATES DO NOT ALLOW LIMITATIONS OF IMPLIED WARRANTIES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU. The total liability of CMAA (including its subcontractors) for any loss, damage, or claim, whether in contract, tort (including negligence and liability without fault), or otherwise, arising out of, connected with, or resulting from this offer of sale or the performance or breach of any contract based upon this Agreement, or use of any Products, equipment, or part based upon this Agreement shall not in any event exceed the price allocable to the Product that gives rise to the claim, loss or damage. In no event, whether as a result of breach of contract, warranty, alleged negligence, or liability without fault and regardless of whether CMAA has been previously advised of the possibilities of such damages, shall CMAA, and its respective parent, subsidiaries, affiliated and member companies, suppliers, employees, agents or representatives (“Released Parties”) be liable for any indirect, incidental, special or consequential damages, including, without limitation, personal injury, death, property damage, loss of profits or revenue, loss of business, or loss of use of the Product described herein or any associated equipment, cost of capital, cost of substitute equipment, parts, or labor costs even if CMAA has been advised of the possibility of such damages.
The Released Parties shall have no obligation, and you shall have no remedy against the Released Parties, for any damages, including but not limited to incidental, consequential, special, punitive damages arising from your ownership, use, storage, handling, or any other actions.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so these limitations and exclusions may not apply to you.Resale
You agree to comply with all applicable laws and regulations of the various states and of the United States. You agree and represent that you are buying for your own internal use only, and not for export. The Products, which may include technology and software, are subject to U.S. export laws as well as the laws of the country where it is delivered or used. The Products may not be sold, leased, or transferred to restricted countries, restricted end-users, or for restricted end-uses. You agree that the Products purchased from CMAA will not to be used for activities related to weapons of mass destruction, including activities related to the design, development, production or use of nuclear materials, nuclear facilities, or nuclear weapons, or chemical or biological weapons. You further agree that you will not sell, lease, or otherwise transfer Product to end-users engaged in these activities.Indemnification
YOU AGREE TO DEFEND, INDEMNIFY AND HOLD COMPLETELY HARMLESS CMAA FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, COSTS, AND EXPENSES, INCLUDING ATTORNEYS’ FEES, ARISING FROM OR RELATED TO YOUR OWNERSHIP AND USE OF ANY PRODUCTS PURCHASED VIA THE WEBSITE.Rights and Remedies
In addition to CMAA’s rights and remedies provided for in this Agreement, CMAA has all rights and remedies that applicable law gives to sellers. CMAA’s rights and remedies are cumulative and CMAA may exercise them from time to time. CMAA’s waiver of a right on one occasion shall not be a waiver of a future exercise of that right.Collection Costs
On demand you shall reimburse CMAA for all out-of-pocket and internal costs that CMAA incurs in seeking to collect from you the purchase price of the Products or to enforce another of your obligations under this Agreement, including without limitation, actual fees of collection agencies and attorneys and internal costs attributable to employees, such as attorneys, paralegals and others. Your reimbursement obligation is in addition to your other obligations, and CMAA’s other rights and remedies, under this Agreement.Time For Bringing Action
An action that you bring against CMAA for breach of this Agreement or for any other claim that arises out of or relates to the Products or their design, manufacture, sale or delivery must be brought within one year after the cause of action accrues.Governing Law and Venue
This Agreement is the entire relationship between you and CMAA regarding the Products purchased under this Agreement. This Agreement shall be considered to have been made in the State of Michigan, and it shall be governed by and interpreted according to Michigan law. Either party may bring an action that arises out of or relates to the Contract in a federal or state court in Washtenaw County, Michigan, that has jurisdiction of the subject matter, and you irrevocably consents that that court shall have personal jurisdiction over you and you waive any objection that the court is not a convenient forum. In any dispute, NEITHER YOU NOR CMAA SHALL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER CUSTOMERS, OR BRING ANY CLAIM AS A CLASS REPRESENTATIVE, CLASS MEMBER OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. Severability If any provision of this Agreement is deemed unlawful, void, voidable or unenforceable for any reason by any court or other tribunal of competent jurisdiction, then such provision(s) shall be reformed without further action by the parties to the extent necessary to make such provision(s) valid and enforceable when applied to such facts or circumstances, with the objective of achieving as nearly as legally possible the same effect.Force Majeure
In no event shall CMAA be liable for non-delivery or delays in delivery of the Products described herein or for failure or delay in the performance of any other obligations contained herein arising directly or indirectly from acts of God, unforeseeable circumstances, acts (including delays or failure to act) of any governmental authority (de jure or de facto), war (declared or undeclared), riot, revolution, priorities, fires, floods, weather, strikes, labor disputes, sabotage, epidemics, factory shutdowns or alterations, embargoes, delays or shortages in transportation, shortages of raw materials, delay or inability to obtain or procure labor, manufacturing facilities, or materials, inability due to causes beyond CMAA's reasonable control to obtain timely instructions or information from you or causes of any other kind beyond CMAA's control. The foregoing provision shall apply even though such causes may occur after CMAA's performance of its obligations has been delayed for other causes.7344118-4
You are solely responsible for the security of online access to this Site and your Account, and you must take precautions to protect the confidentiality of your password and other login information (collectively, your “Account”). You should not share your password or login information with any other person or entity. You are solely responsible for verifying the accuracy of all transactions placed in your Account and for ensuring that you receive a confirmation for all transactions placed for your Account.
Contact Current Motor immediately if you suspect unauthorized use of your password or login information, or any other unauthorized activity on your Account. You must exit fully out of your account at the end of each session. You are and will be responsible for all activities conducted on and with the Site that make use of your password and/or login information, and for any charges or fees incurred by the use of that password and/or login information, including any use you may subsequently contend was not authorized by you. Unless otherwise indicated, all product and service marks and logos displayed on the Site are subject to the trademark rights of Current Motor, its affiliates, or its business partners. You shall not: (a) remove or destroy any proprietary rights marks or legends on or in the Site; (b) modify, enhance, adapt, translate, or create derivative works of the Site; (c) republish, post, transmit, transfer, distribute, assign, sublicense, rent, lease or sell the Site; (d) decompile, disassemble or reverse engineer the Site; (e) reproduce or make copies of the Site; (f) “frame” or “mirror” the Site on any other server or Internet-based device; and/or (g) access, view, download, print, use and/or display the Site for any commercial or other money-making purpose; (h) download or copy Account information for the benefit of another merchant; (i) use any data mining, robots, or similar data gathering and extraction tools; or (j) use any meta tags or any other "hidden text" utilizing Current Motor’s name or trademarks without our express written consent. You acknowledge that certain elements of the Site are, or may in the future be, licensed to Current Motor by third parties and that the availability of such elements may cease automatically, without notice or liability on the part of Current Motor.
